Artists' Bill of Rights

Eligibility

The photography competition 1000for1 (“the Contest”) is opened to all photographers, amateur or professional, aged 18 years and over (or of the age of majority in jurisdictions where the age of majority is over 18 years), from all over the world where such Contests are legal given these Terms and Conditions as published. Collectively, all entrants are “the Participants”.

The Contest is organised by Flabbergast V LTD (“the Organiser”), 1 Albert Embankment, London, SE17XQ, United Kingdom. The Organiser’s employees and their immediate families (spouse, parents, siblings and children) and household members, the Judges and their immediate families (spouse, parents, siblings and children) and household members, as well as affiliates and Organiser’s associates who have participated in the administration of this Contest are not eligible to participate. The Contest is subject to these Terms and Conditions. This Contest is void where prohibited or restricted by law, and is subject to applicable federal, state, provincial and local laws.

“Entries” are digital JPG images in sRGB space, photographic in nature, shot anywhere, depicting any subject and that can be defined as travel photography.

Opening Date: the Contest opening date is the 15th of June 2019.
Closing Date: Entries must be submitted and the Entry Fees paid by the 15th of September 2019 at 23:59:59 GMT. The Organiser reserves the right to change the scheduled Closing Date at any time.
The Contest will be closed prior to the Closing Date if 1000 (one thousand) Participants successfully submit their Entries and pay the relative Entry Fee.

The Participants enters the contest by subscribing to 1000for1, logging in the website, submitting their Entries through the online form and paying the required Entry Fee.
By entering, Participants agree to be bound by these Contest Rules and the decisions of the Judges and/or the Organiser, which are binding and final on matters relating to this Contest.

Entry fees

The Entry Fee for the Contest is USD 24: Participants can upload one to five Entries in total.

Entry Fees must be paid through the Contest’s online secure payment system only after the images have been submitted online. Entry Fees must be received by the 15th of September 2019 at 23:59:59 GMT. Any application without Entry Fee payment will be considered void.

Entry receipt for the Contest is sent via e-mail upon payment and it is your duty to keep a copy of it.

The Organiser does not account or have any liability for any Participants’ bank fees and charges that may be levied in currency conversion and currency transaction by the participating bank(s) or institution(s).

Images eligibility

The images must be photographic in nature (either taken with a digital camera or similar device or scanned from film/print, etc.) and, although every form of post-processing is allowed, must represent a real scene, i.e. no key elements can be added, removed or modified. Participants submitting prize-winning digital entries might be required to produce the original image file before the prize is awarded.

Images must be travel photographs and can represent any subject (object, person, animal, vehicle, land or cityscape, architecture, action or scene, etc.).

Images that have previously won a prize in another international photographic competition are eligible, unless the previous photographic competition prohibits so.
Images that are part of a portfolio that have previously won a prize in another international photographic competition are eligible, unless the previous photographic competition prohibits so.
Images must not bear any visible watermark which could lead to the identification of the author by the judges.

Images must be uploaded as JPG only, with the shortest side at a minimum 720 pixels, no limits to the longest side, any DPI setting, colour-space preferably sRGB, and weigh preferably no more than 5 MB.
The Participants must be in measure to provide a higher resolution image to the Contest when and if they are requested to participate in future exhibitions or Contest catalogues.

Submission guidelines

The Contest submission period begins on the 15th of June 2019 at 12:00:00 GMT, and ends on the 15th of September 2019 at 23:59:59 GMT (the “Contest Submission Period”). All entries must be received and payed for during the Contest Submission Period.

Submissions can be made online at www.1000for1.com by following the “Submit your pictures” link, completing the web entry form in its entirety, uploading the images and paying the Contest Entry Fee.
The payment is managed through PayPal and every major credit card is accepted.
By submitting an Entry through the web entry form at www.1000for1.com, the Participant agrees that the Entry may be showcased in 1000for1 website and on affiliates’ websites for the duration of the Contest.

No Entries without the required Entry Fee, will be processed. Participants may not be notified that their Entry is incomplete. The Organiser retains the right to refuse any Entry for any reason.
The Organiser is not responsible for any problems, bugs or malfunctions Participants may encounter when seeking to submit their Entries. Only complete valid Entries will be accepted.
By submitting, the Participant warrants that his or her Entry does not infringe any third party’s rights, and that the Participant has obtained all necessary permissions from any third party to submit the Entry. All Entries must be original works of authorship created by the Participant who submits the Entry and who must be a natural person.
Participants may not copy or otherwise plagiarise the Entry from any source, nor may the Entry include third party copyrighted material. The Organiser reserves the right to disqualify false or plagiarised Entries or Entries suspected of being false or plagiarised. Participants must hold all rights to the entire Entry and may not be under any contractual relationship that would prohibit them from entering their Entry (or Entries), in whole or in part, into the Contest. The Participant agrees to indemnify the Organiser against any and all claims from any third party for any use by the Organiser, its agents, successors or representatives, of Participant’s Entry. You must adhere to copyright laws in your own jurisdiction and the one where the picture was taken, especially in regards to the photographing of people in public places.
The Participant must be the sole author and owner of the copyright of all images entered. It is the legal responsibility of the Participant, and not the Organiser, to ensure that they comply with these ownership and copyright requirements, and own the rights to reproduction of their images. Entries that do not fulfil these criteria will be deemed ineligible and disqualified. Where this is discovered after the prize has been awarded, the prize must be returned or refunded by the Participant. Participants agree to fully indemnify 1000for1 and its sponsors and employees in respect of all royalties, fees and any other monies owing to any person by reason of the Participant breaching any of the foregoing.

Entries must not contain material that is inappropriate, threatening, false, indecent, lewd, abusive, harassing, pornographic, scandalous, obscene, hateful, tortious, defamatory, slanderous or libellous; they must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; they must not contain material that is unlawful, in violation of, or contrary to the laws or regulations in any jurisdiction where the photograph was taken and in your own jurisdiction; they must not contain any material that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.

Each Entry does not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity.
Entries must not include trademarks owned by third parties; copyrighted materials owned by third parties; names, likenesses, voices or other characteristics identifying celebrities or other public figures, living or dead, unless a relevant model release is obtained; does not contain any commercial content that promotes any product or service.
You confirm that each person depicted in the Entry has granted permission to be portrayed as shown, unless copyright laws in your jurisdiction allow for the photographing of persons in a public place without consent.

Judging

All Judges will be appointed by the Organiser. The winners will be determined by the Judges and the Organiser in accordance with these Terms and Conditions. Their decision is final on all matters relating to the Contest, and the Organiser will not enter into any correspondence regarding the judging or organisation of the Contest. Right of rejection and or right of refusal are at the discretion of the Organiser and can happen at any time. The judging will take place during the end of September 2019.

All Entries will be prescreened to insure the Entries have correctly met the Submission Guidelines and meet with the Organiser’s general standards and practices prior to any judging. Judging will be ‘blind’. No names or other indicators will be shown in judging to lead to the Participant and no names or other indicators are allowed on the Entry that could indicate who is the author of the Entry. Entries will be assigned a random file number for the judging.

Judging will take place in two Rounds. In the first Round all Entries will be scored by 1000for1 staff on the basis of photographic quality, creativity and composition. The highest scoring Entries will be submitted to the Judges for the second Round of judging: these are the Shortlisted Entries. At least 20 Entries will be selected. 1000for1 reserves the right to increase or decrease the number of Shortlisted Entries at any time.
In the second Round, the Shortlisted Entries will be scored by the Judges using the same criteria of the first Round. In the event of a tie, the tied entries will be re-submitted to the Judges for a re-judging between the tied entries alone. The Winning Entry will be the one with the highest score overall.
At any time before, during or after the Contest submission period, the Organiser may, in its sole discretion, choose to post or distribute one or more Entries, their creators’ names and profiles information in any media and on any website (including on the Organiser’s website, YouTube, Twitter or Facebook page(s) and third-party websites) for promotional purposes only. No entry will be directly uploaded on any social media platform or any third-party website that do not comply with 1000for1’s Copyright and Use of Entries, as set in these Terms and Conditions. Images that will appear on social media will be served by dedicated pages hosted on 1000for1.com. Participants understand that users of these sites may share, comment on (including negatively) and re-post their Entries during and after the Contest submission period. Posting of this/these Entry/Entries will not mean that said Entries are eligible to win or are Finalists.

Prizes

The Organiser reserves the right to change the prizes to a comparable alternative due to unforeseen circumstances and any changes will be posted on the competition website. Prizes are not transferable and no cash equivalent will be offered.

If eligible under these Rules, the Winner will receive one (1)  camera of his or her choice to be selected among the following models: one (1)  Nikon Z7 (Approximate Retail Value: USD 3400), one (1) Sony A7R III (Approximate Retail Value: USD 3200) or one (1) Canon EOS R (Approximate Retail Value: USD 2500). The winner has the option to receive USD 3000 transferred to his or her PayPal account instead.
For all prizes, all federal, regional, state and local taxes, fees, custom charges, PayPal fees and other expenses in connection with the prize are the sole responsibility of the Winner. All activities related to the prize are at the Winner’s own risk and subject to whatever restrictions are imposed by the entities that govern activities. The winner is not entitled to any surplus between actual retail value of prize and stated approximate retail value and any difference between stated approximate retail value and actual value of the prize will not be awarded. No substitution, transfer, or cash redemption of prize, provided however that the Organiser reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. Prize may be awarded in the form of voucher(s), coupon(s) and/or gift card(s) in the Organiser’s sole discretion. The Winner is solely responsible for any other unspecified expenses related to the Prizes, including shipping/handling, and any and all federal, state, and local taxes on prizes. If the Winner is unable to participate in or accept the prize or any portion of the prize for any reason, The Organiser shall have no further obligation to the Participant. Prizes will be awarded by international courier, at the Organiser’s discretion. The Organiser is not responsible for lost or damaged prizes.

Use of Entries – Copyright

Artists' Bill of Rights

The competition is run according to the guidelines set by the Artists’ Bill of Rights.

Participants will retain copyright and moral rights in their works, no copyright is transferred to 1000for1 or its partners in respect of any Entry submitted or accepted, the copyright remains those of the Participant and/or any third parties from whom Participant has obtained permission to use the third party’s material(s)
Where an Entry or Entries are reproduced by 1000for1 or its affiliates, the Participant will always be credited. Any failure to provide such credit line shall not be deemed to be a breach, as long as 1000for1 uses its reasonable endeavours to rectify such failure within a reasonable period from the date of notice of such failure.

The Organiser and the sponsors reserve the right throughout the world, except where prohibited by law, to display, reproduce and publish in any media such as publicity, exhibitions, print and digital media, any Winning and Shortlisted Entry, the Participant’s name, photograph and likeness, without limitation and additional compensation, within five years of the Winner being announced, for the sole purpose of promoting, marketing and publicising the Contest.
The Winning and Shortlisted Entries will be displayed indefinitely on 1000for1 website, as a record of achievement unless specifically requested otherwise by any successful Participant.
1000for1 does not claim unlimited license for itself or its sponsors to reproduce the Participants images outside of the terms set out above.
Where image reproduction is unrelated to the Contest then permission and a fee will be agreed with the Participant in advance.
In case the Organiser or any sponsor might approach a Participant with a request for commercial usage of a Participants’ work, the Participant will be free to agree or decline terms and such usage negotiation will be independent of the Contest.
Any rights metadata present in works submitted to the Contest will not be removed, altered, or added by the Organisers or its sponsors. The participant understands though that 1000for1 might re-dimension all entries and that this might modify any invisible watermark placed by the participant.

It is the Participant’s responsibility to protect the Entry/Entries against misuse by third parties. The Organiser and its Partners can assume no responsibility and are not liable for any misuse of your work by third parties.

No Entry displayed on 1000for1’s website will have its longest side exceeding 1024 pixels.

Winners notification

The Winner will be announced during October 2019.

The Winner will be notified by email using the information provided in the registration form. Selected Participants will be required to respond (as directed) to the e-mail notification within 72 hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize; and, in such case, the Organiser may choose the next highest scoring Entry from among the remaining shortlisted Entries.

Privacy

All personal information collected by the Organiser will be used for administration of the Contest and for sporadic email solicitation regarding the organisation of the Contest and future ones. The Organiser fully complies with the Federal CAN-SPAM Act, and allows email recipients the option to opt out of receiving further email solicitations.

Limitation of liability

By participating, Participants agree: (i) to be bound by these complete Official Rules and the decisions of the Organiser which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Terms and Conditions, except where prohibited by law. By accepting a prize, Selected Participants agree to release the Organiser, its parent and affiliated entities together with the respective directors, employees, officers, licensees, licensors and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Contest from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize-related activities. The Organiser assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilised in the Contest, and the Organiser assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, other problems or technical malfunctions with regard to the Competition. The Organiser assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of Entries. The Organiser is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail addressed to the Organisers on account of technical problems, human error or traffic congestion on the Internet or any website, or any combination thereof, including any injury or damage to the Participant’s or any other person’s computer related to or resulting from participation or downloading any materials in the Contest. If for any reason a Participant’s entry cannot be viewed or is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorised intervention, fraud or technical failures, the Organiser assumes no responsibility. The Organiser shall not be liable for any injuries, losses or damages of any kind, including death caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest. Entries may be destroyed. The Organiser may prohibit a Participant from entering the Contest or winning a prize if, in its sole discretion, it determines such Participant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or any other unfair playing practices of intending to annoy, abuse, threaten, undermine or harass any other players or the Organiser’s representatives. The Organiser shall not investigate copyright ownership, which is the sole and exclusive responsibility of Participant. In the event of a dispute arising out of ownership of copyright prior to awarding prize, the Entry will be removed from consideration. In the event of a dispute arising out of ownership of copyright after the awarding of the prize, the Organiser is not responsible for payment of award to any other party and the Winner specifically indemnifies the Organiser from any and all liability associated with any third party claims. The Organiser reserves the right to cancel or suspend the Contest, in its sole discretion, should it receive an insufficient number of Entries, or due to circumstances beyond its control, including natural disasters. The Organiser reserves the right, in its sole discretion, to cancel or suspend the Contest should a virus, bug, computer problem, unauthorised intervention or other causes beyond the Organiser’s control, corrupt the administration, security or proper play of the Contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, THE ORGANISER RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. The information given in these rules is correct, but the Organiser reserves the right to change any of them without prior notice. The revised rules will be posted in this section of the website, and it is the Participants’ responsibility to review this section. By completing the online entry, Participants will confirm that they have read and agreed to be bound by the rules of the competition. Any breach of these rules by a Participant will void their entry. If a breach has occurred, but is discovered after the award of a prize, then the Organiser may request the return of that prize.

Disputes regarding these Official Rules and/or this Contest will be governed by the internal laws of the United Kingdom.
